I do watch a lot of movies and TV shows. Generally most of their problems can be solved via communication. Is this lack of communication just faked for the effect or do couples actually operate this way ?

Example: 40 year old couple, married for 15-20 years, one teenager one almost teen, woman gets knocked up ….. is each honest about what they want ? Do you tell the partner what you think they want to hear, or do you tell them what you feel ?

What secrets do you keep ? When you were just married, what secrets did you keep ?

On another blog somewhere (don’t recall where) on a discussion of Texas law a commenter mentioned that you can be arrested for being drunk in a bar. In a way this is true. In practice it is even more true. However, it generally isn’t legal.

So here it is. Section 49.02 of the Texas Penal Code.

Sec. 49.02. PUBLIC INTOXICATION. (a) A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.

(a-1) For the purposes of this section, a premises licensed or permitted under the Alcoholic Beverage Code is a public place.

(b) It is a defense to prosecution under this section that the alcohol or other substance was administered for therapeutic purposes and as a part of the person’s professional medical treatment by a licensed physician.

(c) Except as provided by Subsection (e), an offense under this section is a Class C misdemeanor.

(d) An offense under this section is not a lesser included offense under Section 49.04.

(e) An offense under this section committed by a person younger than 21 years of age is punishable in the same manner as if the minor committed an offense to which Section 106.071, Alcoholic Beverage Code, applies.

Ok this bit “For the purposes of this section, a premises licensed or permitted under the Alcoholic Beverage Code is a public place.” pretty well means any place that can sell alcohol. It just specifies that bars are included in “public”.

The important bit is this:

A person commits an offense if the person appears in a public place while intoxicated to the degree that the person may endanger the person or another.

Read that. Read it again. One more time. All of Texas law is written pretty much the same. “A person commits an offense if ….“. Everything after the if is what I was taught in the police academy as “elements of the offense”. A person has to meet all of the elements of an offense to be deemed “committing” the offense.

Police in Texas tend to ignore the bold part. The bold part is actually the more important part of the law.

The intent of the Public Intoxication law in Texas is NOT to outlaw being drunk in a public place. The intent is to protect the drunk and those around the drunk. Simply put, if you are not posing a danger to yourself or others, YOU ARE NOT COMMITTING PUBLIC INTOXICATION.

If you are not exhibiting behavior that could lead a police officer to believe that you pose a danger to yourself or others … YOU ARE NOT BREAKING THE LAW!

If you are arrested for Public Intoxication in Texas the one question you should be asking the arresting officer in court is, “What about my behavior that day/night led you to believe I posed a danger to myself or others?”

This does not get near enough attention. Calls/letters could even be written to your local police chief or district attorney pointing this out and asking why so many unlawful arrests are allowed under this statute.

One last note: No, I did not get arrested for Public Intoxication. This is just a pet peeve of mine.

I must admit that I lean towards the agnostic, but atheists bother me more than the devout. If the Christian Bible is correct, then the devout has the advantage over the atheists, but if the Bible is wrong, then both are equal. Heh. Obviously, the devout hold the advantage.

This is why I don’t get the ANTI-God. And I type it that way cause that’s the way the non-believers tend to put it. They try like hell to couch it in “LOGIC”, but logic really dictates that you take no position at all. There simply is no way to know. This is why atheists are nuts and Christians are iffy. Atheists are taking a position based on absolutely nothing. NOTHING. There is no science, no theory, no suggestion that God does not exist. At least Christians are open minded.

I try always to have faith. I really do. The logical brain I was given dictates a need for evidence, but apparently faith is a requirement. Faith without evidence is hard for me. I like to think that there is some reason, some point to life. That we’re not just some accident. Mostly, I hope/pray that there is an afterlife. Death scares the shit out of me. I’m mostly fearless. I don’t scare easy, and I’ve risked my life often when I thought something needed doing. The thought of no longer existing scares the hell out of me and almost nothing scares me.

I have a hard time believing that I’m just some sort of happy accident. It seems odd to me that the very people that scoff at the lottery think that “we” “just happened”.

There’s the “money quote” btw. Atheists, or the “educated” laugh at the state lottery as “a tax for people that are bad at math”, yet think humanity “just happened”. Here’s the kicker …. folks win the lottery. Yep the odds are against any one person from winning, but the odds are just as for someone winning. The Left misses this as well as they miss God.

My understanding is that as long as I accept Jesus as having taken punishment for my sins that I am good/am golden/may as well be Jewish (Jews being the chosen people getting to opt out of the Jesus exception).

I’ve never been much of a church-going type, but I watched Passion of the Christ at the theater on the big screen …. I rate that as disturbing as watching Blackhawk Down at the theater on the big screen (which I did). I think the intent of both films was the same. To allow (as much as is possible) the viewer to witness the events portrayed. But what do you take from that? What are you supposed to take from it?

It is surprising the effect that music has on memory.

People suck. Your average person is a decent enough fellow, but people … well, they suck.

The hardest part about getting along in society is trying to not treat a person like you’d treat people. As hard as it is sometimes, you have to treat every person as an individual. A completely new encounter.

I’m not explaining this right at all. No matter how many people blow right past you when you hold a door for them, never expect the next person to do the same. That 1 in 100 is maybe going to say ‘Thank You’ (rare these days, I know), but more importantly that 1 in 100 might think, just somewhere in the back of his mind, ‘Not everyone’s a dick.’ No matter how shitty a day you’ve had, no matter how pissed off you are that the guy in line ahead of you has 35 items in the fucking express lane you truly have to give your best effort to not lump everyone you meet in with the assholes.

In a way, this is very much the same phenomena as racism. I mean, racism is essentially expecting every member of a race to behave in a certain way. It is just as easy, or hell, even easier, to expect ever person to act the same as every other asshole you’ve ran across today.

I can’t honestly suggest that you treat every individual you encounter in the course of your day equally as if you’ve not encountered any number of assholes before but in the interest of civility I ask that you try. I try. I don’t always succeed and I often find myself being someone else’s asshole but I do try. I suggest you do the same.

You should not read this as a plea to everyone to be a doormat. I’m suggesting no such thing. If some asshole knocks into you in his hurry to get who-gives-a-shit-where and you feel the need to say, “Hey, fuckstick, watch where you’re walking.” by all means, let loose. All I’m suggesting is to not be the first asshole.

When I was in the police academy (yeah, there’s a bit of personal history) we were taught to always let the other guy dictate your behavior. Essentially, this means that you approach every encounter at a normal human polite level of behavior and you leave it to the other guy to decide whether or not you’ll get nicer or turn into a complete dick that just beat him senseless.

This really turned into a whole lot more of a ramble than I first intended.
